Character witnesses testify in Astorga sentencing phase

 

We were in the courtroom Wednesday as both sides presented character witnesses in the sentencing phase of the trial of convicted deputy-killer Michael Astorga.

Astorga faces the death penalty or life in prison for murdering Bernalillo County Sheriff Deputy James McGrane in 2006.

First, McGrane’s mother, father and siblings testified about the lasting pain caused by the loss of McGrane.

Later, during the defense portion of the testimony, Astorga’s wife and other family members talked about his early life and schooling.

Astorga’s wife, Marcella, gave tearful accounts of Astorga’s interaction with his children from prison. Rosemary Astorga, his former step-mother, told the jury about her involvement in his early years of life.

Santa Fe man accused in 2 killings is denied bail

SANTA FE, N.M. (AP) - A judge has denied bail for a 54-year-old man charged with fatally shooting two people in January over a late rent payment.

Arthur Anaya is charged with fatally shooting 16-year-old Austin Urban and 51-year-old Theresa Vigil and fleeing from law enforcement for about four days before officers found him near his property south of Santa Fe.

Our news partners at the Santa Fe New Mexican reported Wednesday that Anaya's lawyer, Joseph Campbell, asked the court to set a $2 million cash bond.

State District Judge Stephen Pfeffer said Anaya must remain in custody, considering his history of fleeing. Anaya has pleaded not guilty to the two counts of first-degree murder and other charges.

NM drought will not hinder summer activities

Despite the dry conditions, New Mexico residents are encouraged to participate in outdoor activities. Last week a joint press conference was held to remind New Mexicans state parks and recreation facilities are opened throughout the state.

New Mexico is experiencing a drought with precipitation lower than normal. State Engineer Scott Verhines said La NiƱa is to blame for the dry winter months, but weather patterns should change during the summer.

Dry conditions spark Santa Fe fire ban

SANTA FE, N.M. (AP) - The Santa Fe Fire Department is imposing additional fire restrictions due to dry conditions.

The department says the restrictions are aimed at preserving lives and property during what it calls "emergency conditions."

Officials say a persistent drought has resulted in worsening fire danger.

The restrictions will be in place until further notice.

Camp fires, pit barbecues, bonfires and all other open burning will be prohibited, along with the burning of weeds and trash.

The use of charcoal barbecue grills in public parks and in recreation areas is also prohibited.

Smoking in parks, recreation areas or on any public trail is forbidden.

The restrictions also put firecrackers, bottle rockets and numerous other fireworks off limits.

Violating the restrictions could result in fines up to $500 and up to 90 days in jail.

Body found in burned mobile home in Santa Fe County

An investigation is underway in Santa Fe County after a body was found in a burned mobile home.

The Santa Fe County Sheriff's Office said they responded to the fire at the El Rancho community near Pojoaque just before midnight on Sunday.

They reported that the body is severely burned, causing difficulty for officials to identify the victim.

Officials said they are waiting on an autopsy.

They are also trying to determine if the fire was a case of arson, investigators said.

Astorga trial jurors to resume deliberations Tuesday

SANTA FE, N.M. (AP) - Jurors are deliberating whether to allow prosecutors to seek the death penalty in the case of a man convicted of murdering a Bernalillo County sheriff's deputy.

Closing arguments to begin Monday in Astorga trial

SANTA FE, N.M. (AP) - Closing arguments are scheduled in the sentencing phase of a man convicted of murdering a Bernalillo County deputy and who could face the death penalty.

The prosecution and defense are slated Monday to give their last arguments to jurors who could then begin deliberations this week in the sentencing trial of Michael Astorga.

Jurors will be asked to sentence Astorga, who was convicted in the 2006 killing of James McGrane, to life in prison or to death, even though New Mexico repealed the death penalty in 2009.

Astorga is still eligible for the death penalty since the crime occurred before the repeal.

Two others remain on the state's death row.
